The rules and regulations of RERA have been carefully formed keeping in mind the rights of the buyers and how to make the industry more organised and transparent. More than the launch of new projects, loads of complaints have flooded into RERA authority from buyers. But still, there are several consumers who do not know how to file a complaint in RERA.

So here is an easy guide to registering a complaint:

If any of the buyer’s right or provisions of the act is violated then a buyer can file a complaint against allottees, promoters or even real estate agents, under Section 31 of RERA either with the adjudicating officer or the Real Estate Regulatory Authority. Several state governments have already laid down procedures to file complaints under RERA and thus the application must be in the prescribed form only as stated by the different state governments.

The buyers first need to visit the respective state government’s RERA portal. The fees for filing the application vary from state to state. Such as in Karnataka the charge is Rs 1000 whereas in Maharashtra the charge is Rs 5000. Then the complainant needs to fill the required details that include complainant name, flat number, the total value of the flat, date of possession, the amount paid till date, filing the complaint against - promoter/ agent, the relief sought, pending court case. In order to take the complaint forward, it is necessary to fill an application with all the required details. The information required for filling the form may vary from state to state. However, it is advised to thoroughly read the sale agreement very carefully before you file a RERA complaint.

Now here the question arises that why to file a complaint with RERA only?
There are several benefits of filing a complaint through RERA. The first and the foremost being RERA has been formed exclusively for handling real estate matters only. That is why RERA ensures a speedy and early solution against the complaint whereas the National Consumer Disputes Redressal Commission (NCDRC) might take some time for the final settlement. And in case you have already filed a complaint in NCDRC and it's pending, then you can withdraw the case and move to RERA. Moreover, promoters can influence or manipulate any provisions of the law. The transparency level is high in RERA, due to which the buyers are able to claim any compensation in case of delayed projects.

However, one needs to be really prompt in order to file the complaint. Any delay can be harmful to the complainant case and you might not get the relief you are looking for. There is no particular time frame to file a complaint but the complaint should be filed on time. The complainant needs to keep their documents ready and file the complaint according to the facts of the case.

Filing a complaint is not a difficult task; one just needs to be aware enough to do so.
