Buying a house is an exciting experience for all of us. However, in this excitement, many forget to verify the safety responsibilities of the occupants. Many incidents have been observed recently where the safety of residents has been compromised. According to National Building Code (NBC) regulation, the builder is responsible for fire safety and protection, the structure of the building and design as well as lightning protection to safeguard health, safety and welfare of a resident.
 
If any accidents happen due to structural causes, the developer is responsible for it. Structural failures include fire or elevator-related accidents. If the developer has already handed over rights to Resident Welfare Association (RWA), the responsibility now lies with the RSA. To quote an example, lift slide accidents are common where residents complain about the developer’s negligence. Uttar Pradesh housing department has proposed Lift Act early this year to bring in some strict safety rules. Otherwise, developers tend to install poor quality lifts to save money compromising safety of occupants.

What’s the cause of such residential accidents in spite of all these? There is a vast gap between supply and demand of lower budget residence. This has led to unregulated constructions to fulfil the demand of lower budget houses. Despite guideline of Development Control Regulations (DCR), widespread practice is still prevailing.
Involvement of inexperienced non-technical personnel in the construction is another reason for the unsafe quality of construction. 

Requirements for Safety Measure

The existing rules and regulations for residential safety must follow these:
  • There should be strict monitoring during the construction and if require penalising the defaulters.
  • Technical qualification of personnel involved in the construction must be checked.
  • Quality Control and management body should be there during the construction activity so that safe residence can be delivered.
  • Regulatory authorities should check on the quality periodically.
  • There should be provision to perform a third-party check at all stages of construction. 
A safe building is a basic necessity of an occupant. Migration to cities has increased manifold with job opportunities, and so is the demand for apartments and other residential properties. This has resulted in unregulated constructions with negligible quality measures. Developers must follow the rules and regulations laid in NBC. However, existing control for fire safety is meant of buildings above 16m. Certain amendments are required in rules and regulations with respect to stairs and fire safety installation.
