Over the years, the interests of the buyers have been exploited by the developers by not keeping their promises. Delays in project completion, not providing the promised facilities, false promises, are not new or unheard from the buyers.

To make things easier for the buyers, RERA was formed, and it came into full force in 2017. RERA was welcomed with open arms by the buyers as it gave the hope of a better future in the real estate sector. Hoping for stricter rules for the developers, the buyers were joyous that there would be a place which will make sure they are treated fairly and will not bear any injustice by the developers.

Recently the hopes of the buyers have been going down the hill since the RERA chief of Madhya Pradesh, Anthony De Sa, stated that the buyers should not go to the consumer forum to address their grievances. He further said that the RERA takes care of the buyer’s interest and makes sure that the project is completed on time whereas the consumer forum, NCDRC, is only focused for the compensation to the buyer and addressing their grievances.

The RERA chief of Haryana and Gurgaon bench, KK Khandelwal, also states last week that the Haryana RERA will not allow the buyers to get the refund if the project has been 40- 50% completed.

In February 2017, the Supreme Court of India made it clear that the buyers are free to approach the National Consumer Dispute Redressal Commission (NCDRC) if there is any disagreement with the developer and the total cost of the property is Rs one crore or more.

The RERA chiefs have also urged that the housing ministry to amend the law which is met with fear that it will also dissolve the consumer rights. The homebuyers association is not pleased with the recent statements made by the RERA chiefs of the states. They worry that the statements and the requests are against the basic rights of the homebuyers since the main aim of the RERA was to protect buyer’s rights and interest and to serves the best possible solution and justice to the buyers.

This is not the first time the RERA authorities have been anti- homebuyers. Earlier the UP RERA asked the homebuyers who complained against the project that has been stalled. The authorities asked the homebuyers to come up with a financial plan to complete the project. This required the home buyers to put in extra money for the project.
