We list down all the documents that you must carefully check before buying the property:
1. Sales deed:
It is one of the most critical documents in the ownership of the property. The document is the legal proof of the name transfer and your ownership on the property. Make sure that the property has a clear title and it is duly registered.
2. Mother deed:
The parent legal document which is used to trace all the previous owners of the property is called Mother Deed. Make sure all the previous owners have been mentioned clearly until the current owner.
3. Construction approval:
To start the construction of any property you need the plan approval from an authorised body. Be it a personal construction or a project built by developers. To get the approval one has to submit the following documents: Title deed, city/ panchayat survey sketch, foundation certificate, latest tax receipt, land use certificate, property assessment extract, property PID number, drawing of the layout, earlier sanctioned plans.
4. Conversion certificate:
A large part of the land in India is agricultural land. To start construction, one needs approval from the revenue authorities, stating the use of land from agricultural to housing. A no objection certificate is required from the tehsildar’s office as well.
5. Encumbrance certificate:
If you are buying a property with a home loan, an encumbrance certificate is a must. This is the proof of money you owe to the bank, title transfer or any legally registered transaction against your property.
6. Power of attorney:
A power of attorney gives one the legal authority to rent or mortgage the property. The POA must be registered as well.
7. Tax receipts:
To ensure there’s no fraud from the owner, you can ask them to show the tax receipt of the property. Of the owner fails to show you the same, then you can approach the municipal office and ask for it.
8. Completion certification:
When buying a property from a builder, ask for the completion certificate. The completion certificate is given out after the property has finished the construction keeping with all the compliances.
9. Occupancy certificate:
Before the buyer can move into the building, a physical inspection is carried out by the municipal body to make sure that the property is habitable and the building has met all the norms laid out. After the occupancy certificate has been given out, one can start living in the building.
