E-registration of a property was introduced for the first time by the Land Registration Act 2002. This was a reformist measure as a major cause of property disputes has been an unclear title. A property passes many hands over generations and the lineage becomes difficult to track. This causes problems among multiple heirs. E-registration was made mandatory by 2015.

According to new measures taken by the authorities, one's Aadhaar Card can now be linked to the e-registration sites. Once the identity is thus confirmed and linked, it can be used for certain transactions where the title of the property does not get transferred such as the leave and license agreement. Once you have linked your aadhar card, you would not need to visit the Registrar to register your property, keep a tab or make changes to the property you own. The registration can now be done remotely. The witnesses required can also be identified through their biometric information to make the procedure transparent and convenient.

In addition, e-registration will also make it possible to save information about the lineage of ownership. In case someone wants to purchase a property and would like to do a background check, they can access the records online. This information will become more reliable and authentic with the linking of the Aadhaar card, making the real estate sector more transparent.

In some states, such as Chhattisgarh, Jharkhand, Karnataka, Kerala, Madhya Pradesh, Maharashtra, Punjab, Sikkim, West Bengal e-registration is already operational. Linking of Aadhaar will be implemented in these states also through an amendment in Section 69 of the Land Registration Act, 2002.

In August 2015, the Supreme Court ordered that Aadhar Card was not mandatory to avail Centre Government’s Schemes, but it recognised the benefits of linking Aadhaar with the schemes and bank accounts. Almost all the schemes of the Centre, such as old age/disability/widow pension schemes to rural employment, Pradhan Mantri Awas Yojana, to educational scholarships, cultural organisations, housing subsidies, industrial and manufacturing workers, and interest subsidy on home loan up to Rs 1 lakh etc, are linked to Aadhaar. Now the real estate sector is also set to view reforms through linking od Aadhar to property registration.

However, there are a number of challenges in accomplishing this goal. Problems like slow speed and connection breakdown are some of the issues faced by home-buyers in Madhya Pradesh. It is still a long way till we can achieve a system of e-registration without buyers having to wait for long hours in the queues.
